1. INTRODUCTION

We, the Alpine Eagle Foundation, a foundation based in Switzerland, (the “Alpine Eagle Foundation”, “we”) are committed to protecting your privacy.

The Alpine Eagle Foundation Privacy Policy (the “Privacy Policy”) is intended to provide you with information relating to the processing (e.g. collection, use, recording, storage or transfer) of any personal data that we may collect through our online platforms (e.g. website, social media networks) (the “Alpine Eagle Foundation Platforms”) or when you complete the contact form (the “Contact Form”), when we organise an event or via any other form of interaction.

The Privacy Policy will answer the following questions:

This Privacy Policy does not apply to any personal data collected from other third-party applications or websites that may provide a link to or be accessible from the Alpine Eagle Foundation Platforms. We are not responsible for the privacy policies and practices of these websites and third-party applications.

2. THE COLLECTION OF YOUR PERSONAL DATA BY THE ALPINE EAGLE FOUNDATION

WHAT IS PERSONAL DATA AND HOW DO WE COLLECT IT ?

We may collect personal information about you (as an identified individual) or that enable us to identify you (your “Personal Data”) in various ways and circumstances:

  • when you visit any of the Alpine Eagle Foundation Platforms, including when you complete our Contact Form;
  • when you make a donation to the Alpine Eagle Foundation;
  • when you contact us by email or telephone;
  • when you fill out one of our forms at an event.

WHICH TYPE OF PERSONAL DATA DO WE COLLECT?

Depending on the purpose and the method chosen to interact with us, we may collect information (which may constitute Personal Data) that you actively provide to us, such as:

  • contact information (e.g. name, mailing address, email address or telephone number).

We may also collect other types of information (which may constitute Personal Data) using automated means, or indirectly from you or third parties (websites and social networks), such as:

  • information that you share publicly on social media as part of your interaction with the Alpine Eagle Foundation.

ON WHAT BASIS MAY WE COLLECT YOUR PERSONAL DATA?

We undertake to process your Personal Data only if and to the extent that at least one of the following legal bases applies:

  • You have given your consent to the processing of some of your Personal Data for one or more specific purposes (e.g. to use our Alpine Eagle Foundation website, to receive newsletters, to be contacted via the Contact Form.
  • The processing is necessary for the performance of a contract (linked to your donations, linked to financial support for the Alpine Eagle Foundation).

Marketing and promotional purposes

  • To send you personal invitations to Alpine Eagle Foundation events as well as communications from the Alpine Eagle Foundation.
  • To send you the newsletter of the Alpine Eagle Foundation by email and keep you informed about our events and initiatives.


Support purposes

  • To process your support and donation requests


Assistance purposes
:

  • To provide you with information about the activities, services and Platforms of the Alpine Eagle Foundation.
  • To respond to your requests.
  • To manage, maintain and optimise the Alpine Eagle Foundation Platforms, provide support and security services.


Legal Purposes
:

  • To comply with the regulations relating to the law governing foundations and to comply with the requirements of the Swiss Federal Supervisory Board for Foundations.
  • To prevent fraud or other prohibited or illegal activities and to ensure the safety and security of the Alpine Eagle Foundation
  • To comply with billing and accounting requirements and any other legal or regulatory obligations (e.g. anti-money laundering legislation).

FOR HOW LONG MAY WE STORE YOUR PERSONAL DATA?

Unless otherwise stipulated by legal or security requirements, we may store or process your Personal Data for as long as necessary to achieve the purposes described above to the extent that you do not withdraw your consent to processing (for one or more purposes) or exercise your right to be forgotten before the expiry of one of these periods (by any means described below in the section “How can you contact us?”). Your Personal Data will be stored in accordance with legal obligations, available technologies and implementation costs.

MAY WE SHARE YOUR PERSONAL DATA WITH THIRD PARTIES? IF YES, WITH WHOM?

We may share your Personal Data with third parties in the following limited circumstances only:

  • With service providers to support us in our activities (e.g. to collect your payment, organise events, email you the Alpine Eagle Foundation newsletter, analyse your use of our website, manage and maintain the Alpine Eagle Foundation Platforms, mitigate risks and help prevent fraud).
  • With a third party, court or other authority if required by law or to assert a legal claim, in the context of a lawsuit, legal proceedings or to combat fraud.

We expect all such third parties to provide the necessary guarantees concerning confidentiality and security and to take appropriate technical and organisational measures in accordance with applicable laws. Our service providers may only process any Personal Data that we share with them in accordance with and within the limits of our instructions.

MAY WE TRANSFER YOUR PERSONAL DATA OUTSIDE OF SWITZERLAND OR THE EUROPEAN UNION?

We do not currently transfer any of your Personal Data outside of Switzerland or the European Union.

4. YOUR RIGHTS

WHAT ARE YOUR RIGHTS WITH REGARD TO YOUR PERSONAL DATA?

  • Right of access: you have the right to know what Personal Data have been collected about you and how these have been processed.
  • Right of rectification: you have the right to request the modification of any inaccurate Personal Data.
  • Right of objection: you may, at any time, indicate your refusal regarding the processing or continued processing (in whole or in part) your Personal Data.
  • Right to be forgotten: you may exercise this right in particular when you no longer consent to the processing of your Personal Data. You have the right to withdraw your consent at any time (by any of the means described below in the “How to contact us” section ). The right to be forgotten is in no way an absolute right and applies only under certain circumstances.
  • Right to restrict processing: you have the right to restrict the processing of your Personal Data, i.e. to restrict the way in which we use your Personal Data. This is another way of exercising your right to be forgotten. This right is in no way an absolute right and applies only under certain circumstances.
  • Right to information: you have the right to obtain clear, accurate, complete and easily accessible information about the processing of your Personal Data.
  • Right to data portability: you have the right to transfer your Personal Data (or request the transfer thereof) from one electronic processing system to another.
  • Right to lodge a complaint with a supervisory authority.

These rights may be subject to exceptions or limitations (e.g. when your Personal Data have been processed for security purposes or retained as a result of a legal or contractual obligation) and take account of the available technologies and the costs of implementation.

In some cases, we will need to verify your identity before processing any request made by you on the basis of the above rights.

HOW DO WE ENSURE THE SECURITY OF YOUR PERSONAL DATA?

We use appropriate technical, organisational and administrative security measures to protect the Personal Data we process against any loss, misuse, unlawful access, disclosure, alteration or destruction.

Nevertheless, even if we make every effort to protect your Personal Data, we cannot guarantee the security of the information that you may be required to transmit on the Alpine Eagle Foundation Platforms when this transits over the internet from unsecured networks.

HOW DO WE ENSURE THE PROTECTION OF YOUR PERSONAL DATA IF YOU ARE AGED UNDER 16?

Note for children aged under 16: We will not intentionally collect or process (in particular through the Alpine Eagle Foundation website) the Personal Data of children aged under 16. If you are aged under 16, please ask a parent (or other legal representative) to register and/or complete the Contact Form for you.

Please do not provide us with any Personal Data. If we discover or are informed that we have inadvertently collected your Personal Data, we will remove these from our records immediately.

Note to parents or other legal representatives: we will not intentionally collect (or process) the Personal Data of your children aged under 16. If you are concerned that your child has registered on the Alpine Eagle Foundation website or has provided us with Personal Data and you wish to cancel these actions, please contact us as indicated above, providing the official documents establishing the status of legal representative.

5. MODIFICATIONS OF THE PRIVACY POLICY

IS THIS PRIVACY POLICY SUBJECT TO CHANGE?

We reserve the right to amend this Privacy Policy at any time. Any material change will be the subject of a notice published on the Platforms of the Alpine Eagle Foundation. It is nevertheless your responsibility to keep informed about any changes made.
